PhonePe Prepaid Payment Instrument (“PPI”) Terms of Use

This document is an electronic record in terms of Information Technology Act, 2000, amendments thereof from time to time and the rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Please read the terms and conditions carefully before registering, accessing, or using the PhonePe Pre-Paid Payment Instrument, herein referred as “PhonePe Wallet”. These terms and conditions, (herein referred as “Wallet T&Cs”) are a legal contract ("Agreement") between You and PhonePe Private Limited ( “PhonePe”) having its registered office at Unit No.001, Ground Floor, Boston House, Suren Road, Off. Andheri-Kurla Road, Andheri (East) Mumbai – 400 093, India. You agree and acknowledge that you have read the terms and conditions set forth below. If you do not agree to these terms and conditions or do not wish to be bound by these terms and conditions, you may not use the Services and/or immediately terminate the Services.

We may amend the terms and conditions at any time by posting an updated version at PhonePe website(s), mobile application and/or other online platforms (hereinafter collectively referred to as “PhonePe Platform”). The updated version of the Terms of Service shall take effect immediately upon posting. It is Your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of PhonePe Wallet following the posting of changes will mean that You accept and agree to the revisions including additional Terms or removal of portions of these Terms, modifications etc. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and avail the Services.

Financial institutions deploy KYC, or “Know Your Customer” process to confirm the identity of their clients and determine the risk of such clients being involved in money laundering or terrorist funding. The Reserve Bank of India (RBI) has mandated that banks and other financial institutions ask their clients for KYC. Once you complete the minimum KYC (self-declaration) process, your KYC status will be updated as ‘minimum KYC’ and you will be eligible to use the PhonePe Wallet with basic wallet features. However, in order to receive full-fledged PhonePe Wallet experience, you must complete the ‘Full KYC’ process. Upgradation of minimum KYC account to the Full KYC account is optional and at your discretion.


Introduction

These terms and conditions regulate the use of Semi Closed Prepaid Payment Instrument or such other services which may be added from time to time under the brand name “PhonePe Wallet” offered by PhonePe. PhonePe has been authorised in this regard by the Reserve Bank of India (RBI) in accordance with the provisions of the Payment and Settlements Act, 2007 and the regulations and directions issued by RBI from time to time.

By proceeding to use the PhonePe Wallet, you (“User”/ “you”/ “your”) signify your consent to be bound by these “Wallet T&Cs” in addition to agreeing to the General PhonePe Terms and Conditions (“General ToU”) and PhonePe “Privacy Policy”. By use of PhonePe Wallet, you shall be contracting with PhonePe and these Wallet T&Cs referenced herein will constitute Your binding obligations with PhonePe.


Eligibility

By registering for PhonePe Wallet, You represent that you are -

You shall not impersonate any person or entity, or falsely state your age or affiliation with any person or entity. PhonePe shall reserve the right to terminate your contract to use PhonePe Wallet in case of any incorrect representation of the conditions mentioned herein.

You agree and undertake to immediately notify PhonePe in circumstances where your PEP status changes, or you become related to a PEP. You should promptly notify PhonePe in writing to ensure that appropriate steps are taken in accordance with applicable laws and PhonePe’s policy . You further understand that as a PEP you will be subject to additional customer due diligence requirements as determined by the regulators. As a PEP you hereby agree to fully comply with all the aforesaid additional customer due diligence requirements as well as cooperate with PhonePe to complete all continuing compliance requirements applicable to a PEP as will be notified to you by PhonePe to ensure uninterrupted use of your PhonePe Wallet.

Issuance of PhonePe Wallet might be subject to additional due diligence, which may include but not limited to reviewing and validating the credential provided by You as part of the PhonePe Wallet application, internally or using other Business Partners / Service Providers, Sanctions Check as notified by regulators, Our risk management process and PhonePe shall have discretion and sole right to issue PhonePe Wallet to You. Hence, by merely sharing the required data may not entitle creation of Your PhonePe Wallet.


Definitions

“PhonePe Wallet”; A semi-closed prepaid instrument issued by PhonePe as per the rules and procedures defined by Reserve Bank of India (“RBI”) and shall refer to Minimum details Prepaid Instrument and KYC Compliance Prepaid Instrument, unless specified.

“PhonePe”; PhonePe Private Limited is a Regulated Entity, authorized by RBI to issue semi-closed prepaid instruments under PSS Act 2007.

“RBI” means Reserve Bank of India

“Politically Exposed Persons” (PEPs) are individuals who are or have been entrusted with prominent public functions by a foreign country, including the Heads of States/Governments, senior politicians, senior government or judicial or military officers, senior executives of state-owned corporations and important political party officials.

"Merchant" shall mean any establishment and/or entity who accepts the PhonePe wallet as a payment method for online or offline purchase of goods and/or services. Similarly, the term "Buyer" shall refer to the person who purchases any of the goods or services provided online or offline by the Merchants and pays for such goods/ services through the PhonePe Wallet.

“PhonePe - Single Sign On (P-SSO)”; Is the login service of PhonePe provided to You, which is used to access all services provided in PhonePe application and participating platforms using your secure and unique credentials.
“terms of use or terms and conditions” are interchangeably used in this document and shall have the same meaning.


Application and Issuance of PhonePe Wallet

This section refers to the different categories of Semi-Closed Wallets issued by Us, is according to the regulatory directives issued by RBI Master Direction on Issuance and Operation of Prepaid Payment Instruments, dated October 11, 2017 (“PPI-MD”), and subsequent updates.

eKYC Wallets

You understand and agree that you are authorizing PhonePe to collect/obtain/retrieve and verify/check your identity and demographic details (Know your customer i.e. KYC details) from Unique Identification Authority of India (UIDAI) basis the details shared by you with PhonePe for the purpose of your e-KYC authentication provided by UIDAI and for the purpose of providing Pre-paid Instrument services (PPI Wallet services / eKYC Account) to you. For the same, you provide your consent to:

Full KYC Wallets

You will be eligible to upgrade your current wallet to Full KYC wallet by undertaking below process:

  1. Aadhaar and PAN verification: Complete your Aadhaar and PAN verifications (“eKYC”). Post completion, you shall be required to provide your additional personal details, as may be required.
  2. Video Verification: As a second step to complete the Full KYC, you need to undergo a video verification, which involves a video call between you and a PhonePe representative. In this video verification call, you shall be required to share a few details and answer some questions.

You understand and agree that you are authorizing PhonePe to collect/obtain/retrieve and verify/check your identity and demographic details (Know your customer i.e. KYC details) from Unique Identification Authority of India (UIDAI) and/or National Securities Depository Limited, basis the details shared by you with PhonePe for the purpose of your Aadhar authentication and for providing PhonePe Wallet services) to you. For the same, you provide your consent to:

  1. Share your details with UIDAI for eKYC authentication through PhonePe
  2. Collection of your identity and demographic information from UIDAI by PhonePe
  3. Submission of your eKYC authentication status/ identity / demographic information with any other Regulatory Authority [including Central KYC Record Registry or PAN verification services (through NSDL/ CDSL or any other permitted agency)] as per applicable laws.
  4. Receipt of sms/email from UIDAI / any agency authorised by it and PhonePe on your registered number/email address.
Pursuant to the same, you understand and confirm that:
  1. You will share/submit any/all documents, in such form and manner as may be required by PhonePe in relation to your application, including but not limited to details as may be required for completion of the e-KYC requirement. Further in case of any changes in your registered Aadhaar/KYC details, you will promptly update such changes to PhonePe.
  2. You confirm that you are providing your consent voluntarily and at your own discretion and opting to share your Aadhaar information to PhonePe and UIDAI, for the purpose of establishing your identity and e-KYC Authentication of the same under UIDAI guidelines or under any applicable law, as may be amended from time to time.
  3. Your Aadhaar details will be used for KYC documentation, e-KYC Authentication, and due diligence, as permitted under applicable law for availing PhonePe Wallet services from PhonePe.
  4. Your Aadhaar details will be used for KYC documentation, e-KYC Authentication, and due diligence, as permitted under applicable law for availing PhonePe Wallet services from PhonePe.
  5. You shall participate in the e-KYC Authentication process and carry out necessary steps needed to complete the e-KYC Authentication process of UIDAI.
  6. You understand and confirm that the records of the Aadhaar e-KYC Authentication process may be used by PhonePe for evidentiary purposes, including for submission before Regulatory Bodies/ judicial or quasi-judicial bodies / Auditors/ mediators or arbitrators and you hereby provide your consent to the same.
  7. Where the details provided by you, including any KYC document or details retrieved by PhonePe through UIDAI / its authorised agencies, do not match or any discrepancies are observed, PhonePe shall not be obligated to provide or continue to provide services to you and may choose to reject your application / discontinue your account/ services in its sole discretion.
  8. If your e-KYC process could not be completed due to any reasons, PhonePe shall not be held responsible towards the same in any manner whatsoever and you shall complete the e-KYC process at your own cost without any recourse to PhonePe. PhonePe shall not be liable to provide the PhonePe wallet services to you unless such e-KYC process is completed to the satisfaction of PhonePe.
  9. PhonePe does not take any responsibility or provide any guarantee whatsoever, even if advised otherwise by you or anyone on your behalf, in respect of any loss, damage that may be incurred by you due to any reasons (including but not limited to technical, systematic or server errors/issues, or any other issue occurred while undertaking e-KYC process).
  10. All particulars, information, and details pertaining to you which shall be received by us through you or on your behalf including from UIDAI in relation to this e-KYC authentication process reflect the true, correct and up-to-date information of yourself in all respects and that you have not withheld any material information that may be required by PhonePe / UIDAI / its authorised Agencies for the purpose of performing e-KYC authentication.
  11. PhonePe, may in its sole discretion may accept or reject your application / request to carry out e-KYC without assigning any reasons and you shall not raise a dispute on the same.
  12. All the processes, limitations, features, and thresholds of the eKYC shall be governed through the eKYC terms and conditions available at https://www.phonepe.com/terms-conditions/wallet/.
  13. In terms of RBI Master Direction on Prepaid Payment Instruments (PPIs) the total amount outstanding in a Full KYC wallet shall not exceed INR Two Lakhs or such other amount as may be prescribed under applicable regulations/circular/guidelines from time to time at any point in time.
  14. Your funds from the Full KYC wallet can be transferred ‘back to source account’ (payment source from where the PPI was loaded) or to the ‘own bank account of the PPI holder’
  15. You provide your consent to PhonePe for recording the video and audio of the entire following VKYC process along with your geolocation.
  16. You must attend the video call yourself only. You will be asked mandatory questions on the video call with the PhonePe representative, which must be answered by you in a truthful and correct manner.
  17. You shall maintain a good lighting environment with minimum background noise/disturbances. PhonePe in its sole discretion may reject the KYC if it feels that the video call is not clear, is fraudulent, ambiguous and/or is not satisfied with the same for any reasons whatsoever.
  18. PhonePe may ask for additional information/documents and/or another video calls, as may be required by it in its sole discretion.
  19. Acceptance / rejection of eKYC and/or VKYC is at the discretion of PhonePe, subject to the verification process and information provided by you.

Please note that the above KYC e-KYC Authentication process is in accordance with the Master Direction-Know Your Customer (KYC) Direction, 2016, issued by Reserve Bank of India (“RBI”) as amended from time to time.

CENTRAL KYC (CKYC): In accordance with the applicable RBI guidelines and other applicable laws, PhonePe shall submit your KYC records with the CERSAI (Central Registry of Securitisation Asset Reconstruction and Security Interest of India) when you transact/complete your KYC on PhonePe Platform. PhonePe shall also retrieve your existing KYC records from the CERSAI for validation. If you are not registered with CKYC, PhonePe shall submit your KYC details provided by you to PhonePe during your KYC verification process. Further, if the KYC details provided by you to PhonePe are updated from the records available with the CERSAI, your details with CERSAI shall stand updated with the current details.

ELIGIBILITY: Full KYC is available to Indian citizens, Indian tax residents, and Indian residents only.

STATUS: For checking the status of your Full KYC, log in to the PhonePe app and Open wallet page, if your VKYC is approved it will show the wallet as upgraded.

CHARGES: PhonePe does not charge the customers for conducting any KYC of its customers.

GENERAL: PhonePe reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these terms and conditions or to replace, wholly or in part. PhonePe shall not be liable for any failure for any technical issues attributable to it because of which the KYC was not successful. By initiating the Full KYC you agree to be bound by these terms and conditions, all the other KYC related terms, standard terms and conditions, terms of use, privacy policy (as amended from time to time) of the PhonePe.

FATCA & PEP declaration from PPI holder: You declare that you are a tax resident of India and not a resident of any other country. You are neither a politically exposed nor related to politically exposed person.
